These Terms & Conditions ("Terms") govern your use of otheating.com and the related digital properties of On Time Heating & Cooling, LLC ("On Time," "we," "us," "our"). They cover what we may and may not be responsible for, the fact that any quote you get on the site or by phone is an estimate, not a binding contract, that AI-assisted content (chat, articles, estimators) is informational and not professional advice, and how we resolve disputes (in Wisconsin, by binding arbitration with a class-action waiver, unless you opt out within 30 days). Your installed-service contract — when you sign one — controls over these website Terms for that job.

1. Acceptance & eligibility

By accessing or using this site, you agree to these Terms and our Privacy Policy, including the Your Privacy Choices / Do Not Sell or Share section. If you do not agree, do not use the site. You represent that you are at least 18 years old and have the legal capacity to agree to a contract in your jurisdiction.

2. Our services

On Time provides residential heating, cooling, indoor-air-quality, and related HVAC services in our published service area in southeastern Wisconsin (including without limitation Waukesha, Brookfield, Pewaukee, Delafield, Menomonee Falls, Oconomowoc, New Berlin, Muskego, Burlington, and surrounding communities). Service availability, scheduling, and pricing depend on technician availability, parts supply, weather, and access at your property.

3. Estimates and quotes are not binding contracts

Any price range, "starting at" figure, calculator output, or website estimate is informational only and is not an offer that you can accept by clicking a button. Pricing for installation, replacement, or non-trivial repair work is finalized in a written, signed proposal or service agreement after on-site inspection.

4. AI & automated-content disclaimer

We may use artificial intelligence to help generate website articles, FAQs, chat replies, size/cost estimators, image suggestions, and other content. AI-assisted content:

• Is intended for general education only.
• Is not engineering, legal, financial, medical, or insurance advice.
• May contain errors, omissions, hallucinations, or outdated code/regulatory references.
• Is reviewed by humans to a reasonable level, but does not represent an individualized recommendation for your property.

Do not rely on AI output for safety-critical decisions (e.g., refrigerant handling, gas line work, electrical work, code compliance) without an in-person evaluation by a licensed technician. AI cost estimators show indicative ranges only; your actual quote can be higher or lower based on the site visit.

5. No professional advice

Information on the site is for general informational purposes. It does not establish a contractor-customer relationship until we accept and confirm your job in writing, and it does not replace the advice of a licensed HVAC contractor, electrician, plumber, permitting authority, or other qualified professional. Always defer to the manufacturer's instructions and to local building / mechanical / electrical codes.

6. Intellectual property & limited license

The site, including text, logos, marks, graphics, software, photos, and the selection, arrangement, and structure of content, is owned by On Time, our licensors, or our content providers and is protected by U.S. and international intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the site for your personal, non-commercial information and to request our services. You may not copy, scrape, mirror, framing, reverse-engineer, sell, or use the site to train any machine-learning model without our prior written consent.

7. Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in violation of these Terms or applicable law.
• Submit false, misleading, or fraudulent information, or impersonate any person.
• Interfere with or disrupt the site, its servers, or networks (e.g., denial-of-service attacks, spamming our forms, malware, or excessive automated scraping).
• Attempt to gain unauthorized access to any portion of the site or to systems we use.
• Use any data, content, or service from the site to train an AI or machine-learning system without our written consent.

8. User submissions

If you submit content (reviews, photos, comments, form notes, chat messages), you represent that you own it or have permission to share it, that it is accurate, and that it does not violate any third party's rights. You grant On Time a worldwide, royalty-free, sublicensable license to use, display, copy, modify, and distribute that content in connection with operating and promoting our business. Do not submit confidential, sensitive, or someone else's personal information through public forms.

9. Third-party services

The site uses or links to third-party services such as HouseCall Pro Online Booking, HouseCall Pro Chat, Wisetack financing, Google reCAPTCHA, Google Maps, payment processors, manufacturer pages, and review platforms. Your use of those services is governed by their own terms and privacy policies. We are not responsible for their acts, omissions, content, fees, or downtime.

10. Warranties & disclaimers (AS-IS / AS-AVAILABLE)

The site and all content, information, materials, software, and functions are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. To the fullest extent permitted by law, On Time disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranty arising from course of dealing or usage of trade. We do not warrant that the site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, that any defects will be corrected, or that the information on the site is current, complete, or accurate at the time you read it.

Warranties applicable to your installed equipment or to service work performed at your property are governed by your separate written agreement, by the equipment manufacturer's warranty, and by our On The Dot Club membership terms (if applicable). This §10 disclaimer applies to the website itself.

11. Limitation of liability

To the fullest extent permitted by law, On Time and its members, managers, employees, contractors, agents, and affiliates will not be liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of revenue, loss of profits, loss of business, loss of data, loss of goodwill, business interruption, or any similar damages, whether in contract, tort (including negligence), strict liability, or otherwise, arising out of or related to your access to or use of (or inability to access or use) the site or our website content.

Our total aggregate liability arising out of or related to your use of the site is limited to the greater of (a) one hundred U.S. dollars (US$100), or (b) the amounts you actually paid to On Time for services in the six (6) months preceding the event giving rise to the claim, with respect to website-related claims. This limitation applies even if a remedy fails of its essential purpose. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless On Time and its members, managers, employees, contractors, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms or any applicable law, (b) your misuse of the site, (c) your User Submissions, or (d) your violation of any third party's rights. We may assume the exclusive defense of any such matter and you will reasonably cooperate with us.

13. Pricing, billing, financing, and offers

Any price published on the site or in marketing material is subject to confirmation in writing before work begins, and may change due to equipment availability, scope changes, permitting, inspections, or access conditions. Financing (when offered) is provided by an independent third party (currently Wisetack), is subject to credit approval, and is governed by that lender's terms. Limited-time offers, specials, coupons, and rebates are valid only for the dates and conditions stated, may not be combined with other offers unless we say otherwise in writing, and may be modified or withdrawn at any time. Online booking does not guarantee an appointment until we confirm it directly.

14. Termination & suspension

We may suspend or terminate your access to the site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination (e.g., §6, §10, §11, §12, §15, §16, §17) will survive.

15. Governing law & venue

These Terms and any dispute relating to them or to the site are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. Subject to §16, you and On Time agree that any action that is not subject to arbitration must be brought exclusively in the state or federal courts located in Waukesha County, Wisconsin, and you consent to personal jurisdiction there.

16. Binding arbitration & class-action waiver

Please read this section carefully — it affects your legal rights.

You and On Time agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the site (a "Dispute") will be resolved by binding individual arbitration, except (a) you or we may bring a qualifying claim in a small-claims court of competent jurisdiction, and (b) either party may seek temporary or preliminary injunctive relief in court to protect intellectual-property or confidentiality rights.

Arbitration will be conducted by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in Waukesha County, Wisconsin (or by phone/online video if AAA agrees). The arbitrator's decision is final and binding. Each party pays its own attorneys' fees and costs, except as the arbitrator awards to a prevailing party where allowed by law.

You and On Time agree that any Dispute will be brought only in your or our individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. Class actions, class arbitrations, and private-attorney-general actions are not allowed under these Terms.

30-day opt-out. You may opt out of this Arbitration & Class-Action Waiver by sending written notice — including your full name, address, the email/phone you used on the site, and a clear statement that you want to opt out of arbitration — to [email protected] within 30 days after you first agree to these Terms. An opt-out applies only to the version of the Terms in effect when you sent it.

If a court rules that the class-action waiver is unenforceable as to a particular claim, that claim (but only that claim) will be severed from arbitration and decided in court; all other claims remain subject to arbitration. If any other portion of this §16 is found unenforceable, it will be severed and the rest of §16 will remain in effect.

17. Dispute notice procedure (before filing)

Before filing any claim, you agree to send a written notice describing the dispute and the relief you seek to [email protected] (subject: "Dispute Notice"). We will work with you in good faith for 30 days to resolve the dispute informally.

18. Notices

We may give you notice by email to the address you provided, by SMS, or by posting on the site; you may give us notice at [email protected] or by mail to 323 W Sunset Dr, Waukesha, WI 53189.

19. Changes to these Terms

We may update these Terms from time to time. The "Effective" and "Last updated" dates will be revised, and material changes will be highlighted on the site. Your continued use of the site after a change takes effect constitutes acceptance of the revised Terms.

20. Severability, assignment, no waiver, entire agreement

If any part of these Terms is held invalid or unenforceable, the rest will remain in full force. We may assign these Terms in connection with a corporate transaction; you may not assign them without our written consent. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms (together with our Privacy Policy and any signed service agreement you have with us) are the entire agreement between you and On Time regarding the site, and they supersede any prior versions.
